1. Agreement to Terms

By accessing or using our services, you agree to be bound by these Terms of Service ('Terms') and our Privacy Policy. If you do not agree to these Terms, you may not access or use the services. You must be at least 13 years old to use our services. If you are under 18, you must have your parent or legal guardian’s permission to use the services.

2. Age Requirements & Verification

  • General Access: You must be at least 13 years old to create an account and use the eSports Arena platform.
  • Cash Prize Events: To participate in any event with a cash prize (including entry fees and prize pools), you must be at least 18 years old or the legal age of majority in your jurisdiction, whichever is greater. To enable withdrawals and participate in cash events, you must complete our Know Your Customer (KYC) identity and age verification process. This is a mandatory step for compliance.
  • Game-Specific Ratings: Certain games on our platform may have age ratings (e.g., 'M for Mature'). By registering for events featuring these games, you confirm that you meet the age requirements set by the game's publisher and any applicable laws in your region.

3. User Accounts

You are responsible for safeguarding your account and for all activities that occur under it. You must notify us immediately of any unauthorised use. You agree to provide accurate, current, and complete information during registration and to keep this information updated.

4. User Conduct and Fair Play

You agree not to engage in any of the following prohibited activities:

  • Using the service for any illegal purpose or in violation of any local, state, national, or international law.
  • Cheating, using unauthorised third-party software, exploiting bugs, or any form of match-fixing.
  • Harassing, threatening, defrauding, or causing distress to other users.
  • Posting any content that is abusive, defamatory, obscene, or racially, sexually, or otherwise objectionable.
  • Attempting to interfere with or compromise the system integrity, security, or performance of the platform.

5. Account Suspension and Banning

  • Consequences: Violation of these rules may result in immediate account suspension or a permanent ban. Banned users will lose access to all platform features, including event registration and wallet functions (deposits/withdrawals).
  • Public Record: Permanently banned users will be listed on the public "Wall of Shame" to ensure community transparency.
  • Pardon System: A banned user may be considered for a pardon after receiving 100 votes from unique, KYC-verified community members. Reaching this threshold does not guarantee an unban; it only qualifies the account for a final review by an administrator.

6. Skill-Based Events and Rules

To ensure fairness and compliance with skill-gaming regulations, all events, particularly those with cash prizes, are subject to strict rules:

  • Approved Games: Events may only be created for games on our official whitelist, which have been vetted to ensure they are predominantly skill-based.
  • Locked Parameters: For cash prize events, specific in-game settings, maps, and modes are mandated by the platform to minimise the element of chance. Event creators and participants are not permitted to alter these settings.
  • Demonstration of Skill: The format of all tournaments and matches is designed to ensure that the outcome is determined by the participants' skill, not by luck.

7. Skill Score & Trust Rating

Our platform uses a Skill Score to rank players based on their performance in competitive matches, which is adjusted using an Elo-based system. We also use a Trust Rating to reflect a player's sportsmanship and reliability. Actions such as late event withdrawals, failing to show up for a match, or being reported for valid reasons will negatively impact your Trust Rating.

8. Financial Transactions

  • Currency: All financial transactions on the platform, including prize pools, entry fees, and wallet balances, are conducted exclusively in United States Dollars (USD) to ensure consistency for our global user base.
  • Event Prize Pools: When you create an event with a cash prize pool, the specified amount will be immediately deducted from your wallet and held in escrow by NUGS Esports until the event concludes and prizes are distributed.
  • Entry Fees: Event creators may set an entry fee. These fees are collected upon registration and are handled according to the event's settings (either contributed to the prize pool or paid to the creator).
  • Charity Events: For events designated for charity, all entry fees and donations collected will be held by the platform. Following the event, the total amount raised, minus any processing fees, will be paid out to the specified charity. An administrative ticket will be created to track this process for transparency.
  • Payouts: Payouts of winnings and wallet withdrawals are subject to transaction fees and may require identity verification (KYC). We are not responsible for any losses incurred due to incorrect payment information provided by you.

9. Teams and Rosters

Users may create or join teams to compete in team-based events. The user who creates a team is designated as the 'Owner' and has full administrative control, including managing the roster, editing team details, and assigning a 'Manager' or 'Captain'. Team owners are responsible for all actions taken by their team.

10. Transfer Market

  • Listing: Players who are 'Free Agents' (not on a team) can list themselves on the transfer market. Team Owners have the authority to list any player currently on their roster. Listing a player makes them available for contract offers from other teams.
  • Offers: Teams may make contract offers to listed players, which can include a sign-on fee and contract duration. An offer is a binding proposal.
  • Acceptance: If a player accepts an offer, they are contractually bound to join the new team. Any agreed-upon sign-on fees will be transferred from the new team owner's wallet to the player's wallet.

11. User-Generated and AI-Assisted Content

You are solely responsible for any content you create, including event descriptions, team profiles, and chat messages. Our platform provides AI-powered tools, such as the event rule generator, to assist you. While these tools aim to be helpful, the generated content is a template. You are required to review, edit, and take full responsibility for the accuracy and fairness of any AI-assisted content you publish.

12. Termination

We may terminate or suspend your access to our service immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms. Upon termination, your right to use the service will immediately cease.
